Car Accident Involving A State Car – Under Insured Injury Claim Law Change
August 1st, 2007If you drive a state car and get in a car accident and get a serious injury like a neck fracture or have back surgery you can now get more settlement money as the Oregon State legislature will soon pass a law allowing under insured claims against the State of Oregon.
For example now if you get a serious neck and back injury in Oregon and get hit by a minimum limits driver who has a $25,000 insurance policy and there is an injury settlement offer of $25,000 you can get an additional potential of $175,000 in under insured motorist compensation money from the state. This applies to passengers in state cars. Our office has handled a few state under insured claims and they are complicated and riddled with procedural items to follow. Its best to check with a lawyer who knows injury law well because like most laws- its very complicated and hard for laypeople to figure out. The under insured motorist law change is good news as there were 802 car accidents involving state cars from 2003 to 2006.
The new under insured motorist state car claim law leaves intact the $200,000 cap on claims against the state.
