Dog Bites In Stores And Restaurants And Other Public Places In Oregon And Washington State

Dogs are everywhere more than ever before. With more dogs comes more bites and injuries to others who go to places people bring their dogs, places like coffee shops, restaurants, and grocery stores.

The businesses who allow dog owners to bring their dogs to their businesses will be secondarily liable as the owner will have primary liability. In handling dog bites cases for the last 17 years I have found that most dog owners will say “My dog will never bite” you whenever one asks them to move their dog.

Most owners who have dogs that bite people are usually in a state of denial when their dog bites so its best to ensure you get all their info down and talk right away to a lawyer to protect your rights after you get looked at in the ER and have reported the case to your county animal control office.

Dog Bite Injury From Bull Mastiff Dog In Washington County In The State Of Oregon

A young child was recently attacked by a bull mastiff in Washington County in the State of Oregon. The Washington County District Attorney’s Office or the “DA” has now announced that there will no criminal charges filed. The owners of the dog could have been criminally charged with either a felony, misdemeanor or a violation.

Since Oregon now has a strict liability law for civil claims but only on the medical and out of pocket bills for dog bites. There may be ramifications for the civil case if the parents decide to pursue the claim. Civil dog bite cases in Oregon are fact specific and will depend upon a comprehensive review of the facts by a skilled lawyer who understands dog bite law.

“The physical characteristics of an animal created by breeding a wolf to a dog are not predictable, similar to that of mixed-breed dogs. In many cases the resulting adult wolfdog may be larger than either of its parents due to the genetic phenomenon of heterosis (known to laypersons as hybrid vigor). Hybrids display a wide variety of appearances, ranging from a resemblance to dogs without wolf blood to animals that are often mistaken for full-blooded wolves. A lengthy study by DEFRA and the RSPCA found several examples of misrepresentation by breeders and indeterminate levels of actual wolf pedigree in many animals sold as wolfdogs. The report noted that uneducated citizens misidentify dogs with wolf-like appearance as wolfdogs.”
